1. Agreement to Terms

By accessing and using CherishMotion services operated by Shem Magnezi ("we," "us," or "our"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Description of Service

CherishMotion provides photo animation services, transforming static photos into short animated videos (approximately 30 seconds in length). Our service includes:

• Professional photo animation with subtle motion effects
• Personalized greeting messages
• Background music synchronization
• High-definition MP4 video delivery
• Delivery within 7 days of payment confirmation

3. Payment Terms

Our service fee is $20.00 USD per video creation, payable upfront before service begins. Payment is processed securely through Paddle. By making a payment, you authorize us to begin creating your video immediately. All sales are final unless covered by our satisfaction guarantee described in Section 7.

4. Content Rights and Responsibilities

You must own or have proper rights and permissions to use all submitted photos. You warrant that your photos do not infringe on any third-party rights including copyright, trademark, privacy, or publicity rights. CherishMotion retains rights to our proprietary animation technology and methods but grants you full ownership of the final video product.

5. Service Delivery

We guarantee delivery of your completed video within 7 days of payment confirmation. Videos are delivered via email as downloadable HD MP4 files. If we fail to deliver within the promised timeframe, you are entitled to a full refund.

6. Acceptable Use

You agree not to submit content that is:

• Illegal, harmful, or violates any applicable laws
• Pornographic, sexually explicit, or inappropriate
• Defamatory, harassing, or threatening
• Copyrighted material without proper authorization
• Contains personal information of others without consent

7. Satisfaction Guarantee

We offer a 100% satisfaction guarantee. If you are not completely satisfied with your video, we will either:

• Create a new version for free based on your feedback, or
• Provide a full refund of your $20 payment

Refund requests must be made within 7 days of video delivery.

8. Privacy and Data

Your privacy is important to us. Submitted photos are stored securely and automatically deleted 30 days after service completion. We do not share your personal information or photos with third parties. See our Privacy Policy for complete details.

9. Limitation of Liability

CherishMotion's liability is limited to the amount paid for our services ($20). We are not liable for any indirect, incidental, or consequential damages arising from the use of our service.

10. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page with an updated "Last modified" date. Continued use of our service after changes constitutes acceptance of the new terms.
